SHELBYVILLE, IL. —
Judge Stephen McGlynn of Belleville is running for appellate judge for the Fifth Judicial District.
“The Fifth District runs from Shelby and Christian Counties to the Indiana and Missouri lines, and south to Kentucky,” McGlynn said in a visit with the Daily Union.
An appellate judge hears appeals from and civil case, any criminal case that originates out of any of the counties he serves. Any criminal case has an automatic right to appeal to appellate court. If anyone thinks their rights were not protected in circuit court, the appellate court reviews the case.
McGlynn is running against Judy Cates for the seat vacated by Justice James Donovan’s retirement in the November 6 election.
McGlynn was appointed by unanimous vote by the Illinois Supreme Court to the position of Appellate Justice in 2005 and served through December 2006. He was appointed by unanimous vote by the Illinois Supreme Court to the position of 20th Judicial Circuit Judge in 2010, the position he is currently serving.
Prior to his appointment he was a partner in the law firm McGlynn & McGlynn in Belleville. He served as Special Assistant Attorney General of Illinois from 1996 to 2005 under both Republican and Democrat administrations. He is admitted to practice law throughout Southern and Central Illinois in both Federal and State Courts.
“I think this is a critical time in the state’s history, we are going to be facing challenges in Illinois that we have not seen before. Everything will end up in the court, especially with Obamacare. There seems to be a lack of respect for our Constitution and the rule of law. When a mayor can say ‘you people cannot have a soda more than 16 ounces’, when a city says ‘you can’t sell chicken sandwiches because we don’t like your owner’s politics’, or a senator that gets a bill governing purchasing of ammunition over the internet and he turns it into an assault weapons ban. There’s things that I’ve seen that really need people who believe in the Constitution, that respect our traditional values and understand the historic importance of our Constitution and what makes it so great, and ensure that individuals’ rights are protected and the government honored. We are over litigated and we are over regulated, and the courts have to do something about that. And that’s why I’m seeking to go to the appellate court,” McGlynn said.
McGlynn was highly rated by the lawyers who appeared before him and the Illinois State Bar Association rated him “highly qualified” to serve as an appellate judge.
“I’m very proud that I’m known for making thoughtful decisions. I try to take time with pro se litigants to help them understand the process and not be overwhelmed by it all,” McGlynn said.
He has been endorsed by Congressman John Shimkus (IL-19).
“I have known Judge McGlynn for a long time. Judge McGlynn has been twice unanimously appointed by the Illinois Supreme Court to serve as both an Appellate and Circuit Judge. He is viewed favorably by his peers in the legal and judicial professions, and his conservative values fit southern Illinois well. Judge McGlynn would make a great addition to the Fifth Appellate Court,” said Congressman Shimkus.
